By purchasing our website design services (“Services”) or using our website, you (“Client”) agree to the following Terms of Service (“Terms”). Please read them carefully before proceeding.

1. Description of Services

Newbill Media designs and builds custom WordPress websites for service-based businesses. Our services include:

• Custom website design based on the selected package

• Delivery of a completed website within 7 days of the confirmed project start date, provided all Client materials are submitted on time

• Unlimited pre-launch revisions within the 7-day project window and within scope

• Ongoing hosting, maintenance, and support as part of a subscription service

2. Payment and Refunds

Premium Packages:

The Client agrees to pay a one-time setup fee and a monthly subscription fee for hosting, maintenance, and ongoing support.

Refund Policy:
Payments are non-refundable except in the following case:

• If Newbill Media fails to deliver the completed website within 7 days due to our own delay (excluding Client delays or revision hold-ups), the Client may request a full refund of the setup fee within 24 hours of the missed deadline.

Starter Plan (Free Website Offer):

The Client agrees to pay a $59/month subscription fee that includes domain registration, hosting, maintenance, and unlimited small updates.
There is a 6-month minimum commitment.
Early cancellation before completing the 6-month term will result in immediate suspension of the website and forfeiture of the associated domain and files.
The first month’s payment is non-refundable. If Newbill Media fails to deliver the website within 24 hours of receiving payment and required info, the Client may request a refund of the first month’s fee.

3. Client Responsibilities

Timely Content & Materials: The Client is responsible for providing all required materials (text, images, branding) before the project start date or immediately after purchase (Starter Plan).
Feedback & Approval: The Client agrees to provide timely feedback on each revision round.
Scope of Work: Requests beyond the original package scope (e.g., extra pages, special integrations) require a new agreement and additional fees.

4. Unlimited Revisions Policy (Premium Packages Only)

Unlimited revisions are available within the 7-day project window only.
The Client must respond to each revision within 12 hours to maintain the guaranteed timeline.

5. Delivery Timeline & Guarantee

• Premium Packages: Guaranteed delivery within 7 days of confirmed start, assuming all materials and feedback are timely.

• Starter Plan: One-page websites will be delivered within 24 business hours of receiving payment and required information.
• 7-Day Guarantee: Newbill Media guarantees delivery of the completed website within 7 calendar days of the confirmed start date, as long as all required materials and timely feedback are provided by the Client.
• Delays Caused by Client: If the Client fails to provide necessary materials or feedback in a timely manner, the 7-Day Guarantee is voided, but the project will still be completed as soon as reasonably possible.
• Client-Initiated Revisions: If the Client requests revisions that go beyond the original scope or cause delays past the 7-day period, the timeline may be extended accordingly.

The 7-Day Guarantee applies to the initial delivery of the project. Revisions are welcomed and will be completed promptly, but may extend the overall completion timeline depending on scope and Client response time.

6. Post-Launch Services

• Hosting, maintenance, and support are included with both plans.

7. Intellectual Property & Ownership

• Premium Packages: Full ownership of the website is transferred to the Client upon full payment.

• Starter Plan: Ownership of the website and domain remains with Newbill Media until the 6-month subscription term is completed. After that point, the Client may request a free transfer of domain and website files. Prior to completing the term, no domain transfers will be permitted unless agreed upon in writing.

8. Limitation of Liability

Newbill Media is not liable for indirect, incidental, or consequential damages related to the use or inability to use our Services. Total liability is limited to the total amount paid by the Client.

9. Governing Law

These Terms are governed by the laws of the jurisdiction in which Newbill Media operates. Disputes will be resolved by binding arbitration or courts in that jurisdiction.

10. Modifications

Newbill Media may modify these Terms at any time. Updates will be posted on our website, and continued use of our Services constitutes acceptance of the revised Terms.
